When you use our website or contact us regarding our services, we process your personal information (“personal data”).

We handle your personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 concerning the protection of natural persons regarding the processing of personal data and the free movement of such data and repealing Directive 95/46/EC (the General Data Protection Regulation “GDPR”), the Privacy Act of 8 December 1992, and the Act of 19 July 2018 concerning the protection of natural persons with regard to the processing of personal data.

The Processing of Personal Data

The term “personal data” includes all information about an identified or identifiable natural person, such as your name, identification number, location data, IP address, contact details, personal characteristics, health data, but also through closed agreements and other documents that allow you to be identified.

Processing” refers to any operation or set of operations that can be performed on personal data, such as collecting, disclosing, or destroying them.

We are responsible for the processing of your personal data unless we process it on behalf of a client or partner. In that case, the client or partner is responsible for the processing of your data.

Collection and processing of your personal data

Please note that if you do not provide your data, we may not be able to respond to your questions, enter into an agreement, or provide our services.

We do not collect personal data that directly identifies you unless you provide this data directly, for example, by contacting us by email or phone, or by visiting our office.

We also automatically collect personal data that does not directly identify you, such as the type of browser you use, your IP address, etc. This is described in our Cookie Policy.

You are solely responsible for the accuracy of the data you communicate and/or enter to us.

Purposes of Processing Your Personal Data

Processing for which we are responsible

We process your personal data primarily in the context of fulfilling our contractual obligations, for the following purposes:

  • Verifying your (personal) data upon registration and ensuring security provisions;
  • Delivering and invoicing our services;
  • Technical administration of our website and managing our client records.

We also process your data where necessary to serve our legitimate interests or those of a third party, for purposes such as:

  • Exercising legal rights, including legal proceedings;

Processing of personal data for which we are not responsible

If we process personal data for a client or partner, we only do so based on a data processing agreement and/or written instruction from one of these parties. We also have their consent to engage subcontractors (“sub-processors”) for the execution of our assignment.

Purposes not covered by this privacy statement

If we intend to process your personal data for a purpose not covered in this privacy statement, we will inform you of this or contact you via the provided email address to notify you of the new processing and its purpose, giving you the opportunity to object to this processing.

Confidentiality

All personal data is kept strictly confidential and is in no case disclosed to third parties, unless we have obtained your explicit, prior consent for this, or if the data is shared with our external technical service providers and/or subprocessors in order to deliver our products and/or services.

Withdrawal of your consent

The consent you have given us to process your personal data can always be withdrawn by sending a written or electronic request along with a copy of your identity card to us. This will be deleted immediately upon identity verification.

Such withdrawal of your consent is not possible for processing activities that occur on the basis of an agreement or processing that is necessary for the protection of our legitimate interests or those of a third party. The withdrawal may therefore affect these processing activities.

The withdrawal of your consent also does not affect the lawfulness of processing that has already taken place based on your consent before its withdrawal.

Retention period of personal data

Your personal data is retained for the period necessary for us to achieve the purpose of the processing and/or to fulfill our contractual obligations.

We retain your personal data in accordance with the legally required retention periods. The personal data we process on behalf of a client/third party will be deleted after the processing is completed. These periods apply unless specific legal provisions require a shorter or longer retention period.

Personal data that we process in order to respond to a question/comment received via email or phone will be stored for a maximum of two years from the time the message is received.

Personal data that we process on behalf of a client or partner will be returned to the client or partner after our processing services end, and any remaining copies will be deleted, unless legal obligations require their retention.

Your rights

Right of access, rectification, and erasure of data

You have the right to request access to your personal data, to rectify incorrect or incomplete personal data, or to request the deletion of your personal data.

Such deletion is not possible if the processing of your personal data is necessary for the conclusion or performance of a contract, or for the establishment, exercise, or defense of legal claims.

Restriction of processing

In certain cases, you have the right to request the restriction of the processing of your personal data, for example: 
if you dispute the accuracy of the personal data, if the processing is unlawful and you object to the deletion of your personal data, if you need the data for the establishment, exercise, or defense of legal claims, while we no longer need the data for processing purposes.
In such cases, we will only store your data. ​

Data portability

You have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used, and machine-readable format, and to transmit those data to another controller. This right does not apply if the processing of your personal data is necessary for the performance of a contract or the establishment, exercise, or defense of legal claims.

Automated decision-making

You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or significantly affects you. This does not apply if the decision is necessary for entering into or the performance of a contract.

Objection

You have the right to object to the processing of your personal data: (1) when the processing is necessary for our legitimate interests, provided there are reasons related to your specific situation, and (2) when the processing is for direct marketing purposes. Such objection is not possible if the processing of your personal data is necessary for the performance of a contract.

Exercising your rights

You can exercise these rights by sending us a dated, written, or electronic request along with a copy of your ID card, or by providing an additional statement if necessary.

If we believe that you are not entitled to exercise one or more of these rights, we will inform you in writing.

Exercising one of these rights in relation to us does not affect the exercise of the same right in relation to our client or partner, and vice versa. If you wish to exercise your rights toward both us and our client or partner, you must address your request to both parties.

Security

We have developed security measures that are appropriate on a technical and organizational level to prevent the destruction, loss, falsification, alteration, unauthorized access to, or accidental disclosure of your personal data collected on our website, or any other unauthorized processing of your data.

In no case can we be held responsible for any direct or indirect damage resulting from incorrect or unlawful use of your data by a third party.

We are not responsible for the content of third-party websites linked from our site, nor for the products or services offered on those sites. Furthermore, our privacy policy only applies to our own website. Since privacy policies of other websites may differ, we recommend that you consult the privacy statement of each site you visit.

Complaints
